Art. 6 para. 1 letter b of the GDPR serves as the legal basis for the processing of personal data necessary for the performance of a contract to which the data subject is a party. The same applies to processing operations necessary for the performance of pre-contractual measures. Art. 6 (1) (c) of the GDPR serves as a legal basis insofar as the processing of personal data is necessary for the fulfilment of a legal obligation to which our enterprise is subject. Article 6, paragraph 1, letter d of the GDPR serves as a legal basis if the processing of personal data is necessary for the vital interests of the data subject or another natural person. Art. 6 para. 1 letter f of the GDPR serves as the legal basis if the processing is necessary for the purposes of the legitimate interests pursued by our enterprise or a third party, unless the interests or fundamental rights and freedoms of the data subject prevail.

3. Data deletion and retention period

The personal data of the data subject is deleted or blocked as soon as the purpose of the recording ceases to exist. In addition, data may be retained beyond this period if the European or national legislator has so provided in EU regulations, laws or other provisions to which the controller is subject. The blocking or deletion of data also takes place when a retention period prescribed by the above-mentioned standards expires, unless the retention of data beyond this date is necessary for the conclusion or performance of a contract.

Non-personal data collected automatically

For organizational and technical purposes, the following data is stored during the use of our website:

Online seminars

Webinars are used for communication between us and a group of people who register online for a digital conference for the purpose of obtaining information. When you register for a webinar, the following data is required for further processing:

We will pass on your e-mail address and your first and last name to Citrix for the purpose of conducting the online seminar in accordance with the order. After the online seminar has been completed, the aggregated statistical data will be forwarded to JUMO GmbH & Co KG. If you have asked a question during the online seminar, we will also receive information about the question asked, such as your first and last name and your e-mail address, so that we can process your request after the online seminar has ended. Newsletter

You have the possibility to subscribe to a free newsletter on our website. When you subscribe to the newsletter, the data from the input mask is transferred to us.

Duration of the recording

The data is deleted as soon as it is no longer required for the purpose for which it was collected. Other personal data collected during the registration process will generally be deleted after seven days.

Online virtual events

We offer you the possibility to participate in virtual events online. For this purpose, we use the service and platform of 6Connex. To register and participate in such events, the following personal data is collected, processed and stored:

In addition, the following data can be optionally indicated: the way in which you became aware of the event and a profile picture

Your data will only be stored in German or European data centers. The storage period is one year. For the processing and use of personal data for marketing and commercial purposes, as well as for the use of your e-mail address in the discussion area, your consent is requested upon registration and you are informed about this privacy statement. You may withdraw this consent at any time.

Participants in such events can use a chat function. The function is also available between participants. In addition, participants have the option of using the Video Chat/Video Meeting feature of Wonder. The tool is not integrated with the 6Connex platform and no data is exchanged between the systems. Using the tool does not require registration, just choosing a name or nickname and giving access to the camera and microphone.

For analysis and statistical purposes, your usage data is collected and processed during the online virtual event. We use these functions on the basis of our legitimate interest in targeted advertising. Retention period

Rights of the person concerned

If your personal data is processed, you are the data subject within the meaning of the GDPR and you have the following rights vis-à-vis the controller:

1. Right to information

You may request confirmation from the controller that we are processing personal data about you.

If necessary, you can ask the person responsible for the following information:

(1) the purposes of the processing for which the personal data are intended;

(2) the categories of personal data that are processed;

(3) the recipients or categories of recipients to whom your personal data have been or will be disclosed;

(4) the intended duration of the storage of your personal data or, if concrete information on this subject is not possible, the criteria for determining the duration of the storage;

(5) the existence of a right to rectify or erase your personal data, a right to limit processing by the controller or a right to object to such processing;

(6) the existence of a right of appeal to a supervisory authority;

(7) all available information about the origin of the data if the personal data is not collected from the data subject ;

(8) the existence of an automated individual decision, including profiling in accordance with Art. 22 para. 1 and 4 GDPR and, at least in such cases, relevant information about the logic involved as well as the scope and expected effects of such processing for the data subject.

You have the right to ask whether your personal data has been transferred to a third country or an international organization. In this context, you can demand to be informed about appropriate safeguards in accordance with Art. 46 GDPR in connection with the transfers.

2. Right of rectification

You have the right to have your data corrected and/or completed by the person in charge if the personal data processed about you is inaccurate or incomplete. The person in charge must proceed to the rectification as soon as possible.

3. Right to limit processing

You may request the restriction of the processing of your personal data in the following circumstances:

(1) when you challenge the accuracy of your personal data, for a period of time that allows the controller to verify the accuracy of the personal data;

(2) the processing is unlawful and you refuse the erasure of the personal data and, instead, request that the use of the personal data be restricted;

(3) the controller no longer needs the personal data for the purposes of the processing, but they are still necessary for you to establish, exercise or defend legal claims, or;

(4) you have objected to the processing in accordance with Art. 21 para. 1 GDPR when it has not yet been established that legitimate reasons of the controller prevail over yours.

If the processing of your personal data has been restricted, such data may only be processed - apart from registration - with your consent or for the purpose of establishing, exercising or defending legal claims or protecting the rights of another natural or legal person or for important reasons of public interest of the European Union or a Member State. If the processing has been restricted under the above conditions, you will be informed by the controller before the restriction is lifted.

4. Right to erasure

Deletion obligation

You may request the controller to delete your personal data as soon as possible and the controller is obliged to delete this data as soon as possible when one of the following reasons applies:

(1) your personal data is no longer necessary for the purposes for which it was collected or otherwise processed;

(2) you withdraw your consent on which the processing is based in accordance with Art. 6 para. 1 letter a or Art. 9 para. 2 letter a GDPR and there is no other legal basis for the processing.

(3) you object to the processing in accordance with Art. 21 para. 1 GDPR and there is no compelling legitimate reason for the processing or you object to the processing in accordance with Art. 21 para. 2 GDPR.

(4) Your personal data has been processed unlawfully.

(5) The erasure of your personal data is necessary to comply with a legal obligation under European law or the law of the Member State to which the controller is subject.

(6) Your personal data have been collected within the framework of the information society services referred to in Art. 8 para. 1 GDPR.

Information to third parties

If the controller has published personal data about you and is required to erase it in accordance with Art. 17 para. 1 GDPR, it will take appropriate measures, including technical measures, taking into account the available technologies and the costs of implementation, to inform the controllers of such personal data that you, as a data subject, have requested the erasure of any links to or copies or reproductions of such personal data.

Exceptions

The right to erasure does not exist as long as the processing is necessary, for example:

(1)  the exercise of the right to freedom of expression and information;

(2)  to comply with a legal obligation which requires processing under the law of the European Union or of a Member State to which the controller is subject or to perform a task carried out in the public interest or in the exercise of official authority by the controller;

(3)  for reasons of public interest in the field of public health in accordance with Art. 9 para. 2 letters h and i as well as Art. 9 para. 3 GDPR;

(4) for archival purposes in the public interest, for scientific or historical research purposes or for statistical purposes in accordance with Art. 89 para. 1 GDPR, insofar as the right referred to in section a) is likely to make it impossible or seriously jeopardize the achievement of the purposes of such processing, or;

(5)  the establishment, exercise or defense of legal rights.

5. Right to notification

If you have exercised your right to correction, deletion or restriction of data processing vis-à-vis the controller, the controller is obliged to inform all recipients to whom your personal data have been communicated of the correction or deletion of data or the restriction of data processing, unless this proves to be impossible or involves disproportionate effort. You have the right to obtain information about these recipients from the controller.

6. Right to data portability

You have the right to receive the personal data you have provided to the controller in a structured, commonly used and machine-readable format. In addition, you have the right to transmit such data to another controller without the controller to whom the personal data was provided having any objection, provided that

  1. the processing is based on consent pursuant to Art. 6 para. 1 letter a GDPR or Art. 9 para. 2 letter a GDPR or on a contract pursuant to Art. 6 para. 1 letter b GDPR and
  2. the treatment is carried out using automated processes.

In exercising this right, you also have the right to request that your personal data be transferred directly from one controller to another, insofar as this is technically possible. The rights and freedoms of third parties may not be affected by this. The right to data portability shall not apply to the processing of personal data necessary for the performance of a task in the public interest or in the exercise of official authority vested in the controller.

7. Right to object

You have the right to object to the processing of your personal data at any time on grounds relating to your particular situation in accordance with Art. 6 (1) (e) or (f) GDPR; the same applies to profiling based on these provisions. The controller will no longer process your personal data unless it can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms or that the processing serves the establishment, exercise or defense of legal claims. If your personal data are processed for the purpose of marketing, you have the right to object at any time to the processing of your personal data for the purpose of such marketing; this also applies to profiling insofar as it is related to such marketing. If you object to the processing of your personal data for marketing purposes, your personal data will no longer be processed for such purposes. You have the possibility of exercising your right to object, in the context of the use of information society services using technical specifications - notwithstanding Directive 2002/58/EC - by means of automated processes using technical specifications.

8. Right to revoke the declaration of consent under data protection law

You have the right to revoke your declaration of consent at any time under the law of personal data protection. The revocation of your consent will not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.

9. Automated individual decision, including profiling

You have the right not to be subject to a decision based exclusively on automated processing - including profiling - that produces legal effects concerning you or affects you in a significant and similar way. This does not apply where the decision:

  1. is necessary for the conclusion or performance of a contract between the responsible party and you;
  2. is permitted under European law or the law of the Member State to which the controller is subject and where such legislation contains appropriate measures to safeguard your rights and freedoms and your legitimate interests or;
  3. is based on your explicit consent

However, such decisions may not be based on particular categories of personal data pursuant to Art. 9 para. 1 GDPR unless Art. 9 para. 2 letter a or g applies and appropriate measures have been taken to protect your rights and freedoms as well as your legitimate interests. In the cases designated in points (1) and (3), the controller takes appropriate measures to safeguard your rights and freedoms as well as your legitimate interests, including at least your right to obtain human intervention on the part of the controller, to express your point of view and to contest the decision.

10. Right of appeal to a supervisory authority

Without prejudice to any other administrative or judicial remedy, you have the right to appeal to a supervisory authority, in particular in the Member State of your residence, place of work or place of the alleged breach if you believe that the processing of your personal data is contrary to the GDPR.

Modification of the confidentiality provisions

We reserve the right to change our data security and privacy provisions if required by technical developments. In this case, we will also adapt our data protection instructions. Please refer to the current version of our privacy statement.
